Florida texting ban:  a good law done wrong?

Shhhhh!  I’m going to let you in on a little secret:  Florida’s ban on texting while driving goes into effect this Tuesday, October 1st.

As the following story indicates, Florida’s commitment to what at one point seemed like a mighty fine idea can only be characterized as suspect at best.  Technically known is Florida’s statutes as F.S. 316.05- the “Florida Ban on Texting While Driving Law“, it seems this act of legislative greatness has lost its luster.


In the interests of full disclosure, I’ve known this law was going into effect for some time now, and I’ve been saying to myself that this is one dang law that’ll be tough for me to live by.  Not proud of having a certain inclination to text from time to time- just telling the truth.

So…Florida legislature and Governor Rick Scott, a couple of questions:

1)  How is this law- called “toothless” by many due to the intended enforcement of it as only a secondary driving violation- supposed to motivate me and others to change our ways?


2)  How can a law be effective if folks aren’t aware of it?  “Ignorance of the law is no excuse” will always prevail in traffic court, to be sure- but is it all that wacky to think a big public safety-type law such as this deserves a bit more publicity?  Just sayin’…

Maybe it is wacky- and a weak law is simply getting the weak kickoff it deserves.
